Vår service
SaveYourDay är ett system där du som användare fyller i de data du önskar. Som en del av servicen arbetar SaveYourDay med olika backuplösningar. Vårt system är byggt på Windows Azure SQL Database, vilket säkerställer att det alltid finns minst tre kompletta kopior av databasen spridda på helt av varandra oberoende system. Utöver denna säkerhet tar SaveYourDay en daglig backup av hela databasen. Trots detta kan inte SaveYourDay garantera att just dina data kan återställas till fullo. SaveYourDay kan inte heller garantera tillgänglighet på server via internet eller mobila applikationer.
Om fel i programvaran
SaveYourDay gör kontinuerliga tester och förbättrar programvaran, men kan inte garantera att systemet är 100% felfritt.
Om vårt ansvar
Om du som användare skulle lida skada, är SaveYourDay inte skyldig att bära några kostnader. SaveYourDay erbjuder tjänster som används på egen risk.
Om lagansvar
SaveYourDay förbehåller sig rätten att stänga av alla användare som bryter mot lagen. SaveYourDay förbehåller sig också rätten att till polisen eller åklagarmyndigheten vidareförmedla all information som du som användare har sparat i SaveYourDay i händelse av att denna information innebär ett lagbrott.
Om en användare bryter mot SaveYourDays policy eller lagen har SaveYourDay omedelbar rätt att suspendera användaren och inaktivera dennes konto. Kontot kommer i sådana fall att sättas i karantän under minst två (2) veckor innan det fullständigt raderas från SaveYourDay.
Om IP-rättigheter och innehåll
Genom att godkänna användaravtalet accepterar du också att inte använda SaveYourDay:s IP-rättigheter till att utveckla lösningar baserat på samma kod och/eller samma idéer.
SaveYourDay får ingen äganderätt till den data som du matar in. Att använda SaveYourDay kommer inte att göra materialet publikt. Du har i alla lägen fulla rättigheter att skapa, redigera och radera data.
Om konton
Om användaren väljer att avsluta sitt SaveYourDay-konto, kommer all data sparas maximalt 180 dagar så att användaren kan återstarta kontot i samma skick som det avslutades.
Om länkat material
SaveYourDay länkar till tredje part. Detta betyder inte att SaveYourDay bekräftar eller delar tredje parts åsikter eller innehåll.
Om användarintegritet
Användaren kommer att ha full integritet förutom där lagen kräver annat.
Om cookies
SaveYourDay samlar information om din webläsare och använder cookies samt liknande saker för att förbättra tjänsten som SaveYourDay tillhandahåller.

The following Terms and conditions (“T&Cs”) of use are valid for SaveYourDay.

Warranties
SaveYourDay is a Service (“Service”) provided on an as is basis. The SaveYourDay web site and material herein are provided without any warranties to the fullest extent permitted by law, including but not limited to availability, timeliness, security, stability, reliability, fitness for purpose, proprietary rights and third party rights, whether it is expressed or implied. The web site is provided on an as is basis, and SaveYourDay makes no warranties, including but not limited to contents, fitness for purpose, links, adverts, graphical contents and appearance. The Service is provided with no warranties, including but not limited to server functionality, server availability, database functionality, that the Service is free from harmful items such as but not limited to software code errors, viruses and software code bugs. If the use of the provided Service and web site results in additional costs for the User (“User”) SaveYourDay is not responsible for any such costs.

Choice of Law and Arbitration
Any dispute, controversy or claim arising out of or in connection with this T&Cs, or the breach, termination or invalidity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce. The arbitral tribunal shall be composed of a sole arbitrator. The seat of arbitration shall be Stockholm, Sweden. The language to be used in the arbitral proceedings shall be English. These T&Cs shall be governed by the substantive law of Sweden.

Limitation of liability
Notwithstanding anything to the contrary in these T&Cs, any other document, at law or otherwise, SaveYourDay shall have no liability for damages (including but not limited to damages caused by any breach of contract, tort or statutory duty or otherwise), nor shall SaveYourDay be liable for any special, indirect or consequential damages or losses such as, but not limited to, loss of revenue, loss of profit, loss of contracts, loss of use, loss of future orders, loss of capital, cost of capital, cost of replacement or costs connected with interruption of operation. The User also waives, both of its own behalf and on behalf of its insurers, any such claims against SaveYourDay and its insurers.

Discontinuation and Suspension
SaveYourDay reserves the rights to modify, discontinue or suspend the Service at any time without further notice and without any liability to its Users.

Survival
If any clause or provision of these T&Cs has been ruled invalid by court of law, such invalidity shall not affect the validity of the remaining clauses or provisions of these T&Cs, which shall remain in full force and effect. In case of termination and or cancellation, the clauses 1. Warranties, 2. Choice of Law and Arbitration, 3. Limitation of liability, 8. Indemnification and 9. Patents, Copyright and Intellectual property rights will all remain in full force and effect.

Content
SaveYourDay takes no responsibility for any content including but not limited to all content provided by its Users. SaveYourDay has no obligation, but reserves the rights to monitor such content and information. SaveYourDay reserves the rights at all time to remove content on the Service that is in violation to the substantial law of Sweden or in violation to the policies and T&Cs of the Service. In case of violation of the substantial law of Sweden or any other violation to a law or policy, SaveYourDay reserves the rights to access, read, preserve and disclose such information to satisfy the full extent of the law and policies. SaveYourDay cannot be held liable for the exercise or non-exercise of its rights. SaveYourDay does not take any responsibility or liability about the accuracy or truthfulness of any information provided in the Service. The User fully agrees to take full responsibility of all contents the said User has entered in the Service.

Changes
SaveYourDay may at its sole discretion modify or change these T&Cs at any time by updating and/or replacing these T&Cs and notifying the Users. Upon accepting these T&Cs the User is bound to accept the said T&Cs and any future modifications or changes.

Indemnification
By accepting these T&Cs the User agrees to indemnify, defend and hold harmless SaveYourDay, its affiliates, agents, subsidiaries, officers, directors and employees, from and against any third party claim, action or demand, arising from or in any way related to the User’s use of the Service, including without limitation any liability or expense arising from all claims, losses, damages, suits, judgments, litigation costs and any legal and accounting fees of every kind of nature. SaveYourDay shall provide notice to the User promptly of any such claim, suit, or proceeding and shall reasonably assist the User, at User’s expense, in defending any such claim, suit or proceeding.

Patents, Copyright and Intellectual property rights
SaveYourDay owns the Intellectual property rights (“IP”) of the SaveYourDay Services including but not limited to the trademark SaveYourDay, the web site, including coding, graphical design, concepts, layout and images and the database. As such, SaveYourDay is protected by international intellectual property law. By accepting these T&Cs the User agrees to honor SaveYourDay’s IP and not by any means copy, distribute, alter, modify or reproduce the IP owned by SaveYourDay, including but not limited to the web site, database, any design, text, software coding, templates, mobile applications or any hardware of software merchandise sold by SaveYourDay. SaveYourDay claims no IP ownership of any of the content the User submits on the web site. Such submittal does not make the contents publically available and the User retains its intellectual property rights and full ownership of such rights. If the User specifically provides SaveYourDay a non-exclusive right to use the said content, SaveYourDay is free to use the User’s IP including but not limited to any material, web site and template.
The data provided by the User will remain private unless the User elects to make it public by changing the account settings. The User may at any time remove the contents it has provided to SaveYourDay. The User confirms that any contents it provides is its own original work and that the User has rights to use the work and that it does not infringe any of the substantial law of Sweden or any other police connected hereto.
SaveYourDay may at its sole discretion remove any and all material that infringes on any third party IP. SaveYourDay cannot be held liable for the exercise or non-exercise of its rights.

Termination and Cancellation
The User may at any time cancel or terminate this agreement with simultaneous stop of use of the Service provided by SaveYourDay. For a termination and cancellation to be valid, the User must close down its SaveYourDay account. SaveYourDay will retain the User’s information during a period of maximum 180 days. SaveYourDay will erase the traceable User account information and all associated data, SaveYourDay can however not guarantee that all data will be found.
SaveYourDay will terminate the agreement if the User violates the agreed T&Cs. In such case, the termination will be effective immediately from the same day notification. SaveYourDay may also terminate the agreement if a User account is inactive for more than 12 months. Before any such termination, SaveYourDay will notify the User in writing and give the User a minimum time for reaction of 4 weeks to reactivate the User account. For the avoidance of doubt, SaveYourDay will retain its right to assign the terminated User account name to any other User without further notification to the terminated User.
Independently of any termination or cancellation, clause 5 and all connected clauses will survive such termination or cancellation.

Third party contents
SaveYourDay provides links to third party content and publish adverts of third parties. In no case provides such links or adverts an endorsement by SaveYourDay of the third party content, neither through third party web sites nor advert texts and pictures. SaveYourDay cannot be held liable for any third party content that may appear through such link or in such advert. If the User finds the third party content offensive or in any way illegal, the User is obliged to notify SaveYourDay in writing.
SaveYourDay cannot be held liable for the exercise or non-exercise of its rights. The User is fully liable for any consequences of accessing a third party link or advert.

Privacy
The User will have full privacy except in cases where SaveYourDay is required by law, legal processes and governmental requests or as otherwise stated in these T&Cs, where SaveYourDay retains its full rights to disclose any User information including but not limited to account information and information stored in database. SaveYourDay will not sell any information to any third party, except if SaveYourDay is sold as a company.

Account information
The User must provide current, accurate identification and contact information that is required during the User account registration process and/or continued use of the provided Service. The User is fully responsible for maintaining the confidentiality of the User account password and user name. The User is fully responsible for all information and content in connection to the User account. SaveYourDay reserves the full rights to refuse Service to anyone without further notice for any reason. SaveYourDay stores the User account information details.

User information collection and storage
SaveYourDay collects and stores information, including but not limited to cookies, email addresses, country of residence and web browser information to optimize the use of the Service. SaveYourDay uses third party suppliers for, including but not limited to, server hosting, web site hosting, web shop logistics and payment transfers. SaveYourDay will only transfer the necessary User information required by law and for the third party to complete its task.

Security breach
In case of a security breach, the User must promptly notify SaveYourDay in writing of such breach.

Payment details
SaveYourDay uses secure third party payment providers. SaveYourDay will not store any credit card details in our servers.
